A participant is not eligible for more than one Giveaway Item during the Giveaway Period. There are a total of 8,300 Giveaway Items. Immediately after logging in or registering, participant will receive a confirmation if they are a Qualified Participant and will be asked to verify shipping address for fulfillment purposes (each a “Giveaway Winner”). Giveaway Winners will receive their Giveaway Item within 6-8 weeks following verification of eligibility and confirmation as a winner of the Giveaway Portion of this Promotion. B. Essay Promotion for Lunch With Dr. Oz

The Essay Portion of the Promotion begins at 9:00 AM Eastern Time ("ET") on December 19, 2011 and ends at 8:59 AM ET on December 20, 2011 ("Essay Promotion Period"). Each contestant who wishes to enter must complete an essay about “Why you want to transform yourself in 2012." Essays must not exceed 300 words in length and must be submitted in English to http://doctoroz.com/videos/win-private-lunch-dr-oz-30-rock. Essays must be sent to Sponsor in the manner requested by Sponsor and received by Sponsor no later than December 20, 2011 at 8:59 AM ET. Limit one (1) entry per person/user per household. Entries generated by script, macro or other automated means are void. All essay entries become the property of Sponsors and will not be acknowledged or returned. By submitting an essay, each entrant represents and warrants that they own the copyright in and to such essay and further grants Sponsors the non-exclusive right to use that essay (or any portion thereof) for unlimited runs, worldwide, in perpetuity in any and all media now known or hereafter devised in connection with the Promotion and/or the “Dr. Oz Show” or any other programming (including television, digital download, radio) created by Sponsors and the marketing, advertising and promotion thereof. The winner for the Essay Portion (“Essay Winner”) will be selected, at the sole discretion of Sponsor, on or about March 21, 2012 from all eligible entries received. Entries will be judged on originality, composition and overall impact. The judges are a panel of Sponsor staff members.

Essay Winner will receive a trip ("Essay Prize") for the Essay Winner and one (1) guest accompanying Essay Winner (individually and collectively, "Attendees") to travel to New York, New York to attend a special taping of “The Dr. Oz Show.” At the sole discretion of Sponsor and provided Essay Winner's principal residence is more than one hundred (100) miles from New York, NY, the Essay Prize may also include roundtrip coach class transportation by air from a major city closest to Essay Winner's principal place of residence to New York; hotel accommodations (room and tax only) for up to two (2) days/one (1) night; ground transportation while in New York City; and lunch with Dr. Oz at 30 Rockefeller Plaza. All matters with respect to the Attendees' mode of transportation, hotel accommodations and ground transportation shall be determined and selected by Sponsor in Sponsor's sole discretion. The Essay Winner must be available and willing to travel to New York, New York on or before May 30, 2012 and to attend a special taping of "The Dr. Oz Show" on May 31, 2012. Sponsor is only responsible for booking return transportation following the taping on or before May 31, 2012. The Essay Prize is provided to the Attendees only. Sponsor is not responsible for booking travel, hotel accommodations, ground transportation or tickets to “The Dr. Oz Show” taping for more than one (1) guest accompanying Essay Winner to New York. Travel is based on availability, blackout dates apply and some carrier and hotel restrictions may apply. Essay Prize details are subject to change. (Approximate Retail Value ("ARV") of the Essay Prize is $3,000.00 US in the aggregate) depending upon the Essay Winner's principal place of residence). Attendees are solely responsible for all expenses, costs or fees associated with acceptance and/or use of the prize not specified herein as being awarded including, without limitation, any and all taxes, transportation, food, gratuity and hotel charges. Essay Winner may not substitute, assign or transfer Essay Prize, but Sponsors reserve the right, at their sole discretion, to substitute an Essay Prize with one (1) of comparable or greater value. Essay Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsors. Essay Prize details are at Sponsors' sole discretion.

C. Additional Terms and Conditions

The Giveaway Winners and the Essay Winner will be notified by email, phone, postal mail and/or express mail at Sponsor's sole discretion. Inability to contact a winner or the return of any Giveaway Item or Essay Prize (individually and collectively, “Promotion Items”) notification as undeliverable will result in the Promotion Item being forfeited and an alternate winner will be selected from the remaining eligible entries. Total ARV of all Promotion Items is $965,279.00. Promotion Item Winners may be required to complete an affidavit of eligibility, a liability release and (where legal) a publicity release, which must be returned within time period specified in notification letter or an alternate winner may be selected. If Promotion Item Winner is 18 or older, as is required for entry, but not of the age of majority in state of residence, Promotion Item will either be awarded in the name of parent or legal guardian, or parent or legal guardian must ratify and sign any and all documents required of winner. Winner's guests, or a parent/legal guardian if winner is under the age of 18, must complete and return a notarized liability/publicity release prior to issuance of a Promotion Item. 

Odds of winning will be determined by the number of eligible entries received. No Promotion Item transfer or cash redemption. No Promotion Item substitution, in whole or in part, except by Sponsor due to Promotion Item unavailability or any other reason as solely determined by Sponsor, in which case a Promotion Item of comparable or greater value will be awarded. 

4. GENERAL:

Taxes on Promotion Item and all expenses related to acceptance and use of Promotion Item are the sole responsibility of winner. By participating, entrants agree [a] to these rules and decisions of Sponsor, which shall be final in all respects relating to this Promotion; [b] to release, discharge and hold harmless Promotion Entities from any and all injuries, liability, losses and damages of any kind resulting from their participation in the Promotion or their acceptance, use or misuse of Promotion Items including, without limitation, personal injury, death and property damage; and if a winner, [c] to permit Promotion Entities to use his or her name, photograph, likeness, statements, biographical information, voice, voice likeness and city and state address for advertising, publicity and promotional purposes in all media, including but not limited to on air and within www.doctoroz.com in perpetuity, without compensation (unless prohibited by law) and agree to execute specific consent to such use upon request. Sponsor, its promotional partner, their respective affiliates, subsidiaries, advertising and promotion agencies, agents and representatives, and the officers, directors and employees of each are not responsible for and shall not be liable for [a] any human error which may occur in the processing of entries; [b] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, or server malfunction which may occur in the processing of entries; [c] failed, incomplete, garbled or delayed computer transmissions; [d] late, lost, misdirected, stolen, illegible or incomplete entries or postage-due mail; or [e] any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right to cancel, modify or suspend the Promotion or any portion thereof should virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the promotion. Sponsor may proceed in a manner deemed fair and equitable by Sponsor in its sole discretion. Entry information becomes property of Sponsor. Internet entry must be made by the entrant only at the authorized web site address of the Promotion Site. Entries may not be made by any other individual or any entity, and/or originating at any other Internet website or e-mail address, including but not limited to commercial Promotion subscription notification and/or entering service sites. Any winner who enters by any of the methods described above will be disqualified and an alternate winner selected. Use of any device to automate entry is prohibited. Sponsor reserves the right in its sole discretion to disqualify any entry at any time in the event it is determined that the entrant has not complied with these Official Rules. This Promotion is governed by the laws of the State of Illinois, with jurisdiction and venue in Cook County, Illinois, and all claims must be resolved in the courts of Cook County, Illinois.  

5. ENTRY INFORMATION:

Personal information collected from entrants during the Promotion is subject to Sponsor's privacy statement available at Privacy Policy and except as otherwise provided in these Official Rules, will be treated in accordance with the terms of that statement. Information collected from entrants in connection with this Promotion will be used Sponsor for purposes of administration of the Promotion and the fulfillment and verification of Promotion Item awards. Sponsor may engage certain third-party companies to perform services in connection with the administration of this Promotion and information provided by entrants may be collected and used by those third parties for purposes of administration of the Promotion and the fulfillment and verification of Promotion Item awards.
